The Ukrainian IT company Starlink is preparing for a new court in order to protect the right to trademark, which the American giant SpaceX is asking to cancel. This was reported by AIN.UA with reference to the owner of the Ukrainian company and trademark Serhii Dulytskyi.

According to him, SpaceX filed an appeal – the case about Starlink trademark will continue to be considered on August 15. Proceedings in it were resumed at the request of SpaceX by the Northern Economic Court of Appeal.

“They sued us to cancel our TM, they are actually attacking my business, we have to defend ourselves, we have no other way out. We will defend our interests in court,” explained Dulytskyi.

As you know, the American SpaceX has sued the Ukrainian LLC Starlink in order to prohibit the use of trademark, which is completely consistent with the name of its satellite business Starlink.

“They built their claims on the fact that Starlink is a world-famous brand and that only because of this we should give up our trademark. They submitted an application to the Ukrainian National Office of Intellectual Property and Innovation, and this 20-page document was half made of links to the media proving Starlink is a well-known company,” the owner of the Ukrainian company recalled.

At the beginning of March this year, the Commercial Court of Kyiv completely rejected SpaceX’s claims. On June 8, it ruled for SpaceX to pay UAH 480,000 for expenses for legal assistance and UAH 60,000 for expenses related to the expert examination.

Note that the Ukrainian Starlink was founded about 15 years ago. Billionaire Elon Musk launched the American Starlink in 2014, and in 2017 began registering trademark in the USA.
