Nintendo files lawsuit against Genki for making and displaying unofficial Switch 2 mockups

Nintendo has filed a lawsuit against accessory maker Genki, accusing the company of trademark infringement, unfair competition, and misleading consumers. The lawsuit concerns the public demonstration of unofficial Switch 2 mockups at CES 2025, Engadget reports.

The lawsuit alleges that Genki used Nintendo logos without permission and advertised accessories that were supposedly compatible with the new console, despite not having access to an official device. Nintendo believes the company was trying to capitalize on the hype surrounding the Switch 2 to undermine sales of its original accessories.

After the first mockups appeared in January, Genki claimed that it did not own any version of the Switch 2 and that its renderings were based on leaks. However, Nintendo called these claims contradictory and noted that Genki continued to mislead users.

Nintendo officially announced the Switch 2 on January 16. The console will go on sale on June 5, with pre-orders starting in April. The company claims that even after the announcement, Genki continues to "parasitize" on the brand, including hosting its own Genki Direct broadcast right after one of the Nintendo Directs.

In response, Genki said it "takes the lawsuit seriously" and is working with lawyers. The company also emphasized that it remains independent and proud of its developments, which it plans to present at PAX East.
