Apple has said it did nothing illegal by choosing OpenAI for its Apple Intelligence artificial intelligence functions over Elon Musk’s xAI. The company is asking a judge in Fort Worth, Texas, to dismiss the case, Bloomberg reports.
The case itself began in late August. Then Elon Musk filed a lawsuit against Apple and OpenAI, accusing them of monopoly. The billionaire said that Apple "imposes" ChatGPT on users by choosing this chatbot for artificial intelligence functions, and not Grok from xAI.
In its response, Apple argues that the antitrust harm alleged in Musk's lawsuit is based on "speculation on top of speculation." Apple's lawyers also say that even though the company initially teamed up with OpenAI, "it is widely known that Apple intends to partner with other generative AI chatbots" in the future.
X Corp., which includes both xAI and the X social network, is demanding billions in compensation from Apple and OpenAI, believing that Cupertino's cooperation with OpenAI is hindering the development of artificial intelligence and limiting user choice.
Lawyers for the iPhone maker, Elon Musk's company, say Apple cannot partner with OpenAI "without simultaneously partnering with every other generative AI chatbot—regardless of quality, privacy or safety considerations, technical feasibility, stage of development, or commercial terms." But they add that antitrust law does not require that.
