Discord is fighting to preserve the anonymity of its users in a lawsuit over piracy on the platform. The process was initiated by the South Korean game publisher Nexon. This was reported by The Verge.

Nexon claims that Discord has refused to comply with a court order that ordered the platform to disclose information about users associated with suspected intellectual property infringement. The publisher claims that Discord users use the platform to distribute pirated versions of video games.

Discord responds that the order could violate Discord users’ “decisions to remain anonymous, an aspect of their freedom of speech protected by the First Amendment.”

Nexon believes that under the Digital Millennium Copyright Act (DMCA), companies can apply to a federal court to provide information about a user who is suspected of copyright infringement.

“Discord is committed to fulfilling its obligations under the law, but acting as your copyright assertion partner is not one of them,” writes a Discord lawyer.

Discord’s legal representative called Nexon’s demands “improper and overly burdensome” and stated that Discord had already provided Nexon with “Basic Subscriber Information for a distinct set of 64 User IDs”. According to Discord, Nexon is now asking for information on more users for violating one of the same copyrights. “You are attempting to renegotiate a deal that has already been struck and fulfilled,” the company’s lawyer writes.
