Usually, when confronted by Nintendo, most emulator developers and console hackers simply comply with the company’s terms and conditions in the hope of minimizing the consequences. But not Ryan Daly, the alleged owner of ModdedHardware.com, who is being sued by Nintendo. This was reported by Ars Technica.
Nintendo claims that it first contacted Ryan Daly in March 2024 about his website selling modified Nintendo Switch consoles and other devices that enable piracy.
Access to the site is currently restricted, but an archived copy is available.
At that time, Daly agreed to refrain from selling these counterfeit goods, according to Nintendo. But a few months later, he resumed sales and ignored further requests from Nintendo representatives. As a result, the company filed a lawsuit in a federal court in Seattle, USA.
In response, Daly denies each of Nintendo’s legal claims. He argues that Nintendo has no reason to believe that he is the owner of ModdedHardware.com and that he did sell modified Nintendo consoles.
In addition, Daly has a whole list of arguments in his defense, including going to arbitration in accordance with the EULA, not recognizing Nintendo’s copyrights, and accusing Nintendo of fraud.
It seems that Ryan Daly is well prepared, but he will still have to face one of the most fearsome “legal bullies”, as they say about Nintendo lately.
