In California, the owner of the Cybertruck electric pickup truck has filed a class action lawsuit against Tesla, accusing it of failing to fulfill advertising promises regarding the Foundation Series equipment. CarScoops writes about this.
Plaintiff Eric Schwartz claims he paid an additional $20,000 for an upgrade that was supposed to include an LED off-road light bar on the roof, but received a vehicle without the feature. Schwartz attempted to resolve the issue directly with Tesla by requesting the light bar be installed, but after unsuccessful attempts, he filed a lawsuit.
The document states that he suffered "actual damages" because he did not receive the product he had already paid for. The lawsuit aims to represent the interests of all Cybertruck Foundation Series buyers in California who did not receive the promised upgrade.
Schwartz's legal team also says that many customers might have refused to buy if they knew that Tesla's advertising materials were misleading and that the company did not intend to deliver the advertised equipment.
This isn't the only lawsuit Tesla has faced in California recently. Earlier this week, a California court ruled that the company must respond to a class-action lawsuit accusing it of spreading false information about its self-driving capabilities.
The lawsuit alleges that Tesla failed to deliver on promises made on its website, blogs, social media, and public statements by Elon Musk. The plaintiffs allege that these statements influenced their decision to purchase vehicles that did not actually have the features they claimed.
