Elon Musk's lawyer said that OpenAI's refusal to fully restructure into a commercial business "changes nothing." As a result of such a statement, the billionaire will likely continue to pursue a lawsuit against the manufacturer of ChatGPT, Bloomberg reports.

"OpenAI’s announcement is a transparent dodge that fails to address the core issues: charitable assets have been and still will be transferred for the benefit of private persons, including Altman, his investors and Microsoft," said Marc Toberoff, Musk's lead lawyer in the case against OpenAI.

Musk sought to block OpenAI from going commercial. His appeal was denied, but he was allowed to continue his lawsuit over the startup's other anticompetitive practices. He also made an unsuccessful bid to buy out the assets of the nonprofit that controls OpenAI for $97.4 billion.

Representatives of the startup commented on the statement of Elon Musk's lawyers to Bloomberg. They claim that the entire lawsuit of the billionaire is simply an attempt to slow down the development. Previously, the company even suggested that Musk uses this legal system to hinder competitors.

"Elon continuing with his baseless lawsuit only proves that it was always a bad-faith attempt to slow us down," says an OpenAI spokesperson.

At the same time, Toberoff says the restructuring plans were rethought to avoid legal scrutiny. He says that doesn't change the fact that the company continues to contradict its original mission, which was to create artificial intelligence for the benefit of all people.
