A federal court in Northern California has rejected Elon Musk's request for an injunction that would have stopped OpenAI from becoming a commercial company, Bloomberg reports.
The court noted that plaintiff Musk did not provide sufficient evidence to warrant an immediate injunction against the restructuring of OpenAI. Judge Yvonne Gonzalez Rogers said she is not inclined to grant injunctions in “billionaires vs. billionaires” cases.
However, the court agreed to expedite the trial between the parties on an important issue: whether OpenAI's transition to a commercial basis is legal.
The decision marks another step in Musk's lawsuit against OpenA, which accuses the ChatGPT developer of abandoning its original non-profit mission of making AI research accessible to everyone.
Just a few weeks ago, Elon Musk made a $97.4 billion takeover offer for OpenAI, which was unanimously rejected by OpenAI's board of directors. The company is currently in talks with investors to achieve a valuation of $300 billion.
